Terms of Use & Privacy

1.Who this agreement is with

InkBurst Auto Shorts is developed and published by InkBurst Ltd ("InkBurst", "we", "us"). By downloading, installing or running the App, you ("you", "the user") agree to these terms. If you do not agree, do not install or use the App.

The App is distributed and billed through Patreon, at patreon.com/cw/Inkburst_Ltd. Your relationship with Patreon itself (payments, refunds processed by Patreon, your Patreon account) is governed by Patreon's own terms, separately from this page.

2.Your license to use the App

While you hold an active, paid Patreon pledge at the relevant tier, InkBurst grants you a personal, non-exclusive, non-transferable license to install and run the App for your own content creation — commercial or non-commercial.

Each license key is issued for one device at a time. If you need the App on a second machine, that requires a separate license/pledge-linked activation, not a transfer of the existing one. You may not share, resell, sublicense or redistribute your license key, or the installer itself, to anyone else.

You may not reverse-engineer, decompile or disassemble the App beyond what's permitted by law, remove or alter license checks, or use the App to build a competing product.

3.Tiers, billing & cancellation

Feature access is cumulative by tier (Auto Shorts → Highlights → Full → Full + AI Tag Gen), as described on the pricing page. All billing is handled by Patreon on a recurring monthly basis — InkBurst never sees or stores your card details.

If you cancel or your pledge lapses, anything you've already rendered stays on your machine. Features above the tier you're no longer paying for (or all gated features, if you cancel entirely) lock again on the next license check until you resubscribe. There is no separate "data deletion" to request, because the App never uploads your footage anywhere in the first place.

Refunds are handled under Patreon's own refund policy, not by InkBurst directly — we don't process payments and can't issue refunds ourselves. If you believe you were charged in error, your first stop is Patreon support; message us on Patreon as well and we'll help however we can.

4.Your own accounts & API keys

Several features connect to third-party services using your own credentials, which you provide and control entirely from the App's Settings:

• YouTube & TikTok — Direct Publish uses your own OAuth login to those platforms. InkBurst never sees your platform password, and the upload goes straight from your machine to the platform.
• AI Tag Gen (£34.99 tier) — AI-generated titles, descriptions, tags and thumbnail layout suggestions are produced by sending your prompt/description to Anthropic's API using your own API key, which you supply and pay for directly with Anthropic.

Because these are your own accounts and keys, you're responsible for keeping them valid, funded and in good standing, and for complying with each third party's own terms of service (YouTube's, TikTok's, and Anthropic's). InkBurst is not liable for — and has no control over — those services' uptime, pricing changes, API changes, rate limits, content policies, account suspensions, or any cost you incur using your own key.

InkBurst Ltd is an independent tool and is not affiliated with, endorsed by, or sponsored by YouTube, Google, TikTok or Anthropic.

5.Your content & your responsibility

You are solely responsible for the footage you load into the App and for anything you render, publish or distribute using it. That includes:

• Making sure you have the rights to the source VOD/footage (your own recording, or footage you're otherwise licensed to clip and republish).
• Complying with the terms of service, community guidelines and monetization policies of any platform you publish to (YouTube, TikTok or otherwise) — including anything triggered by third-party music, game publisher assets, or guest likenesses in your footage.
• Any consequences of publishing AI-generated titles, descriptions, tags or thumbnails — you should review AI output before publishing, the same way you'd review any other draft.

InkBurst is a local editing and automation tool. It does not review, moderate or take responsibility for the content you choose to create or publish with it.

6.Privacy & data

InkBurst is built to keep your footage on your own machine:

• Moment detection and rendering happen 100% locally using ffmpeg. Your VOD, clips and renders are never uploaded to InkBurst's servers — we don't have any servers that touch your footage.
• The only automatic network call the App makes on its own is a license/tier check against your Patreon pledge. No analytics, no telemetry, no background tracking.
• Every other outbound call is one you trigger: a YouTube/TikTok publish, or an AI Tag Gen request to Anthropic using your own key. Those calls go directly from your machine to that service using your own credentials — InkBurst isn't a middleman that sees the payload.
• We don't collect your email address. Support happens through Patreon messages, tied to your existing pledge, so there's no separate contact list or mailing database to manage.

Because we don't operate servers that store your content, there's no InkBurst-side database of your footage, renders, or titles/descriptions to request deletion of. Your Patreon account data (name, email, pledge history) is held by Patreon under their own privacy policy.

7."As is" & no warranty

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including (to the extent permitted by law) warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the App will be error-free, uninterrupted, or compatible with every system configuration, GPU, or ffmpeg build.

Windows SmartScreen or Defender may flag the installer as unrecognized — this is a known false positive common to PyInstaller-packaged apps that aren't yet code-signed, not a sign the App is unsafe. Details are on the FAQ.

8.Limitation of liability

To the maximum extent permitted by law, InkBurst Ltd and its developer(s) are not liable for any indirect, incidental, special, consequential or punitive damages — including lost profits, lost data, lost footage, demonetization, channel strikes, or platform account actions — arising from your use of the App, even if advised of the possibility of such damages.

Where liability cannot be fully excluded under applicable law, InkBurst's total aggregate liability to you for any claim arising from the App is limited to the amount you actually paid via Patreon for the App in the 3 months preceding the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, such as liability for death or personal injury caused by negligence, or fraud.

9.Intellectual property

The App, its source code, UI design, branding and documentation are the property of InkBurst Ltd. Your license lets you run the App — it doesn't transfer any ownership of the software to you.

You retain full ownership of the footage you load and the Shorts/Highlights/Montages/thumbnails you render with it.

10.Termination

Your license is tied to an active Patreon pledge at the relevant tier. It ends automatically if your pledge lapses, is cancelled, or is refunded. We may also suspend or revoke a license key used in breach of these terms (for example, sharing one key across many devices, or circumventing the license check).

Sections that by their nature should survive termination — including "As is" & no warranty, Limitation of liability, and Intellectual property — continue to apply after your license ends.

11.Changes to these terms

We may update this page as the App gains features or as our obligations change. Material changes will be flagged in a Patreon post. Continuing to use the App after an update takes effect means you accept the revised terms; if you disagree, stop using the App and cancel your pledge.

12.Governing law

These terms are governed by the laws of England and Wales, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of England and Wales, without regard to conflict-of-law principles — except where local consumer-protection law in your own country gives you rights that cannot be waived, in which case those local protections still apply alongside this clause.
